If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the least degree necessary to remedy the invalidity or unenforceability while retaining as much of the original intent of the provision as possible.

16. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Manning Web Company Inc. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term. In other words, if we do not immediately take action on a violation of these Terms, it does not mean we are giving up any rights (or preventing us from taking action in the future).

These Terms (together with the separate Privacy Policy, Cookie Policy, Affiliate Disclaimer, and Medical Disclaimer that are incorporated by reference) constitute the entire agreement between you and the Company regarding your use of the Site.
